1. Service

Zolvira LLC ("Zolvira," "we," "us," or "our"), a Limited Liability Company formed in the State of Pennsylvania, provides AI-powered outbound email automation software that helps agencies, freelancers, and solopreneurs automate cold email campaigns, manage prospect responses, and book meetings. By accessing and using Zolvira's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. We reserve the right to modify or discontinue the service at any time with reasonable notice. You must be at least 18 years of age to use this service.

2. User Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when registering. You are solely responsible for the outreach campaigns you configure through Zolvira and must ensure all activity complies with applicable laws, including anti-spam legislation (CAN-SPAM, GDPR, CASL, etc.). You agree not to direct the platform to contact recipients who have opted out or otherwise withdrawn consent. Zolvira automates your outreach — but all campaigns configured through the platform are your campaigns, and you bear full legal responsibility for their content and compliance.

3. Outreach Compliance & Indemnification

You acknowledge that Zolvira provides automation infrastructure and that you, not Zolvira, are the sender of all emails transmitted through the platform. You are solely responsible for ensuring your outreach campaigns comply with all applicable laws and regulations, including but not limited to the CAN-SPAM Act, GDPR, CASL, and any other applicable anti-spam or data protection laws in your jurisdiction and the jurisdictions of your recipients.

You agree to indemnify, defend, and hold harmless Zolvira LLC and its owners, officers, employees, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the platform; (b) the content of any emails sent through your account; (c) your violation of these Terms; or (d) your violation of any applicable laws or third-party rights.

4. Payments & Refunds

Paid plans are billed on a recurring monthly basis via Stripe. All fees are non-refundable except at Zolvira's sole discretion. Refund requests submitted within 48 hours of the start of a new billing cycle may be considered on a case-by-case basis — email support@zolvira.app to request one. You authorize us to charge your payment method on file for the subscription plan you select. If payment fails, we may suspend or terminate your access to the service. Prices are subject to change with 30 days written notice.

5. Prohibited Use

You may not configure or instruct Zolvira to send spam, phishing emails, malware, or any illegal content. You may not use the service to harass, threaten, or impersonate others. You may not attempt to reverse engineer, decompile, or extract source code from the platform. You may not resell or redistribute access to Zolvira without prior written permission. You may not direct Zolvira to contact recipients who have opted out or requested removal from your lists. Violation of these terms may result in immediate account termination without refund.

6. Intellectual Property

All content, features, functionality, branding, code, and technology comprising the Zolvira platform are owned by Zolvira LLC and are protected by applicable intellectual property laws. Your use of the platform does not grant you ownership of any part of the service. You are granted a limited, non-exclusive, non-transferable license to access and use the platform solely for your own business purposes in accordance with these Terms. Any unauthorized use, reproduction, or distribution of Zolvira's intellectual property is strictly prohibited.

7. Termination

Zolvira reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice, at our sole discretion. Reasons may include but are not limited to violation of these Terms, suspected fraudulent or abusive activity, non-payment, or any other reason we deem appropriate. Upon termination, your right to access the platform ceases immediately. You may also cancel your account at any time from your account settings.

8. Disclaimer

Zolvira is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that results obtained from using the service will be accurate or meet your expectations. Email deliverability depends on many factors outside our control, including recipient mail servers, sending reputation, and third-party infrastructure. We do not guarantee inbox placement rates, open rates, or reply rates.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Zolvira LLC or its owners, employees, or representatives be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your use of or inability to use the service; (b) any unauthorized access to or use of our servers or your data; (c) any interruption or cessation of transmission to or from the service; or (d) any bugs, viruses, or other harmful code transmitted through the service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to Zolvira in the 3 months preceding the claim.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the service shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Pennsylvania. By agreeing to these Terms, you waive your right to a jury trial and agree not to participate in any class action lawsuit against Zolvira. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
